Can I use my daughters nursery school payments as a tax deduction?

April 30th, 2010

My daughter attends nursery school. I was wondering if either myself or her father *we are together, not married* who file our taxes seperatly could use the money we paid as some sort of deduction on our tax return?
We live together so the child resided with us both for the entire year.
we both work, I work from home.

Who did the child live with?
    Did that parent work?
If yes, that parent can use what they paid (but not the other parent’s money) for the child care credit.

A child’s school tuition is not tax deductible. If you pay child care required so that you can work or attend school, there is a credit for that. See IRS Publication 503.
